ACMA takes action against 7 telcos for failing to comply with TCP Code

The Australian Communications and Media Authority has ordered telcos AirTel, Just ISP, New Sprout, City Communications, 1Telecom, and PennyTel to comply with the Telecommunications Consumer Protections Code after failing to submit compulsory compliance statements in 2021 and fined Exetel for $13,320 after also failing to submit the same documents in 2019.

The Australian Communications and Media Authority (ACMA) said under the code, telcos that supply services to residential and small business consumers must provide compliance attestation statements each year to the independent compliance monitoring body Communications Compliance.

The statements are required to show that a telco has met all of its obligations under the TCP code, which protects customers who use mobile phone, landline and internet services, and includes rules for issues such as:

1. advertising and sales information;
2. bills and disputes;
3. how to assist customers in financial hardship.
4. the ways customers can pay;
5. how to assess credit for new customers.

The ACMA has required that the telcos mentioned above must lodge their 2022 compliance attestation by 1 September 2022.
